WWE, Cody Rhodes, and Fanatics have been granted an additional extension to respond to a legal action initiated by musician Wesley Eisold regarding the “American Nightmare” trademark.
Eisold, who is the lead singer of the band American Nightmare, launched the lawsuit in September 2024. In the lawsuit, he alleges trademark violation, breach of contract, and disruption of contractual relations. Eisold claims that since 2016, he has been in ownership of the trademark. Moreover, he had a contract in 2021 that permitted Rhodes to employ the name under specific stipulations, which included obvious references to Rhodes in the merchandise.
The musician argues that WWE and Fanatics are breaching that contract by distributing “American Nightmare” products with negligible or no references to Rhodes. This, he contends, results in market confusion — an example of which is fans sporting wrestling merchandise to his performances and associating his band with unrelated wrestling content. He is requesting at least 0,000 in damages, potentially escalating to 0,000, along with legal expenses. The defendants now have until June 7, 2025 to respond.
