New Briefs Filed In WrestleMania 38 Injury Lawsuit

There has been a recent development in the lawsuit filed by Marvin Jackson over a hearing loss suffered at WrestleMania 38.

Pwinsider is reporting that the honorable court asked both the plaintiff and defendant to submit supplemental material by Friday pleading for their requests regarding arbitration.

WWE filed a brief that mentioned a separate court case involving a cruise line that set a legal precedent. The court had ruled in favor of the cruise in that lawsuit, which had a woman suing claim that she never entered into an agreement with the authorities because her daughter had made the bookings and brought her onboard.

In his filing, Jackson argued that even if WWE meets the burden of proof that the lawsuit should go to arbitration, he had “put forth sufficient evidence to create genuine disputes of material fact as to both: (1) his notice of the arbitration agreement; and (2) Jackson being considered a third party beneficiary.”

Jackson noted that previous Supreme Court rulings favor his argument, and requested an oral hearing to argue the case.

The honorable court has yet to make a ruling.
